These Terms of Service ("Terms") govern your access to and use of ApnaMoment, including apnamoment.com and app.apnamoment.com (the "Service"). By using the Service, you agree to these Terms and our Privacy Policy.
Changes to these Terms
We may update these Terms at any time. The "Last updated" date at the top of this page shows the current version. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree, stop using the Service.
Eligibility
You must be at least 18 years old to use ApnaMoment. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Accounts and host responsibilities
Hosts sign in through Google OAuth. You are responsible for maintaining the security of your Google account, for all activity under your moments, and for keeping your account information accurate. Notify us at support@apnamoment.com if you suspect unauthorized access.
As a host, you are responsible for configuring gallery access controls, enabling moderation when appropriate, communicating to guests how uploads will be shared, and complying with applicable laws when collecting guest photos.
We may suspend or terminate your access at any time if you breach these Terms, if required by law, or if your conduct affects the Service or other users.
Acceptable use
You agree not to:
- Upload content you do not have the right to share, including photos of others without consent where required by law
- Upload pornography, nudity, or other sexually explicit or adult-oriented content
- Upload illegal, harmful, harassing, or otherwise objectionable content
- Attempt to disrupt, probe, or reverse engineer the Service
- Misrepresent your identity or affiliation
- Harvest or collect user data without consent
Content and ownership
You retain ownership of photos and other content you upload. By uploading content, you represent that you have the right to share it and you grant ApnaMoment a limited, non-exclusive license to store, process, display, and transmit that content solely to provide the Service — including syncing photos to the host's Google Photos albums and displaying them in galleries and slideshows the host enables.
We do not claim ownership of your content.
Event galleries are accessible only via QR codes, private links, or passwords the host shares. Hosts control whether galleries are password-protected or moderated. Guests should only upload content they are comfortable sharing with the host and others who can access the gallery.
Your own backups
ApnaMoment is not a backup service. Although we may perform routine maintenance or backups of Service infrastructure, we do not guarantee that content will be preserved, restored, or free from loss or corruption. Syncing to Google Photos depends on Google services, network conditions, and your account settings.
You are responsible for maintaining your own copies of important content. Hosts should verify that uploads appear in their Google Photos albums and keep independent backups of anything they cannot afford to lose.
Google Photos integration
The Service uses Google APIs to store photos in the host's Google Photos account. Your use of Google services is subject to Google's terms and policies. ApnaMoment is not responsible for changes to, interruptions in, or loss of data within Google services.
Service availability and modifications
The Service is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. During early access, features may change frequently. We are not liable for any modification, suspension, or discontinuation of the Service.
You may experience temporary interruptions due to maintenance, updates, technical issues, or circumstances outside our control. Uploads are subject to per-file size limits and rate limits.
Intellectual property
The Service, including its software, design, branding, and documentation, is owned by ApnaMoment and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or other proprietary materials without our prior written consent.
Links to other websites
The Service may link to third-party websites or services. We do not control and are not responsible for their content, policies, or practices. Accessing third-party sites is at your own risk.
Copyright infringement
If you believe content on the Service infringes your copyright, contact us at support@apnamoment.com with a description of the copyrighted work, the location of the infringing material, and your contact information. We may remove content that we believe infringes intellectual property rights.
Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR AVAILABILITY.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, FREE OF HARMFUL COMPONENTS, OR THAT CONTENT WILL BE STORED, TRANSMITTED, OR SYNCED WITHOUT LOSS OR CORRUPTION.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APNAMOMENT AND ITS OPERATORS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, CONTENT, PROFITS, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS.
Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless ApnaMoment and its operators from any claim, loss, or demand (including reasonable legal fees) arising from your use of the Service, your content, your breach of these Terms, or your violation of any law or third-party rights.
Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends. Disclaimers, limitations of liability, and indemnification survive termination.
Content already synced to Google Photos may remain in the host's Google account subject to Google's policies. Deleting a moment in ApnaMoment does not automatically remove content from Google Photos.
Dispute resolution
If you have a dispute with us, contact support@apnamoment.com first so we can try to resolve it in good faith. If we cannot resolve the dispute informally, it will be handled as described under Governing law below.
Governing law
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles, except where mandatory local law applies.
General
These Terms, together with the Privacy Policy, constitute the entire agreement between you and ApnaMoment regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. We may assign our rights and obligations under these Terms; you may not assign yours without our consent.
